Services Provided
FixIt4U LLC agrees to provide the following services to Client:
Home Inspection Services:
FixIt4U LLC Inspections are performed by a certified, licensed, and insured Home Inspector and are conducted in accordance with the ASHI Standards of Practice (SOP). The purpose of the inspection is to evaluate the home and its associated systems for general function and safety based on visible and accessible conditions at the time of inspection. Items listed as “not included” in the inspection agreement do not preclude reporting on those items if they are observed to be present during the inspection
Home Repair Services:
FixIt4U LLC provides residential and light commercial repair, maintenance, and installation services, including but not limited to carpentry, minor plumbing and electrical repairs, drywall repair, roofing repairs, appliance and furniture installation and repair, small-scale renovations, combustible gas detection, and sewer drain inspection. Services are limited in scope and complexity and are performed in compliance with applicable Arkansas laws and regulations. All repair projects are limited to a maximum total contract value of two thousand dollars ($2,000), in accordance with Arkansas Contractors Licensing Board requirements.
Mechanic Services:
FixIt4U LLC provides diagnosis, repair, and maintenance services for small engines under 1,000cc, including those used in lawnmowers, chainsaws, trimmers, generators, outdoor power equipment, ATVs, and motorcycles. Services also include electric and battery-powered equipment. All work is limited to small engine systems and components and does not include full vehicle repair, modification, or services requiring manufacturer or dealer-level certification.
Other Services:
Any other services within FixIt4U LLC’s scope and agreed upon by both parties.
Independent Contractor Status
FixIt4U LLC is an independent business entity and not an employee of the Client. No employer-employee relationship exists between FixIt4U LLC and the Client. FixIt4U LLC retains full control over the manner, methods, tools, and schedule used to perform its services. While FixIt4U LLC will remain responsive to the Client’s reasonable needs and concerns, the Client may not direct or control how FixIt4U LLC conducts its work. The Client will not provide employee benefits, tools, or work equipment, except for access to water and electricity necessary for the completion of services.
Compensation and Payment Policy
The Client agrees to pay FixIt4U LLC all fees for services rendered as outlined in the applicable inspection agreement, work order, or service agreement. Payment for inspection services is due at the time the inspection agreement is signed and prior to the inspection being performed. Payment for repair and mechanic services is due upon completion of work unless otherwise stated in writing.
Invoices itemizing labor, parts, materials, and reimbursable expenses will be provided. All invoices must be paid in full within seventy-two (72) hours of receipt. Past-due balances may be assessed a late fee of $25 or 3% per month, whichever is greater. FixIt4U LLC reserves the right to withhold inspection reports, documentation, or release of equipment until payment is received.
The Client is responsible for reimbursement of all approved out-of-pocket expenses, including parts, materials, transportation, parking, and permit fees. In the event of unforeseen conditions or scope changes, pricing may be adjusted with Client approval. If additional work is declined, the Client remains responsible for payment of services performed to that point.
Accepted payment methods include cash, credit cards, Venmo, Cash App, PayPal, business checks (commercial clients only), and cashier’s checks. Personal checks are not accepted.
Cancellations made less than 24 hours before a scheduled appointment are subject to a $50 cancellation fee. Failure to provide access or be present at the scheduled time may result in the full trip fee being charged. Refunds are not provided for completed services except as required by law. Disputes must be submitted in writing within seven (7) days of service completion.
Warranty
Inspection Services:
FixIt4U Inspections do not include any warranty or insurance for the Client or any other party. There is no warranty, expressed or implied, associated with the inspection service or the inspection report. The inspection and resulting report are not a guarantee or warranty, expressed or implied, of the condition, performance, or remaining service life of any system, component, or item inspected or not inspected. The inspection is a professional opinion based on visible conditions at the time of the inspection only.
Repair and Mechanic Services:
All repair and mechanic services are provided without warranty, express or implied. FixIt4U LLC makes no guarantees regarding future performance, durability, or service life of repaired or serviced items.
Liability
FixIt4U LLC’s liability is limited to the total amount paid by the Client under this Agreement. FixIt4U LLC shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, revenue, or data, unless caused by gross negligence or willful misconduct. The Client agrees to indemnify and hold FixIt4U LLC harmless from any claims, losses, or damages arising out of FixIt4U LLC’s performance of the services, except where such claims are directly related to negligence or willful misconduct.
Force Majeure
FixIt4U LLC shall not be liable for any delay, interruption, or failure to perform services resulting from events beyond its reasonable control, including but not limited to acts of God, severe weather, natural disasters, fire, flood, pandemics, governmental actions, labor disputes, utility outages, or supply chain disruptions. In such circumstances, performance obligations shall be suspended for the duration of the event. FixIt4U LLC will notify the Client as soon as reasonably practicable and, when possible, provide an updated service schedule.
